What should you tell the permit office?
Have the parcel address, waterbody, existing permit number if known and a simple description ready. State whether you want to repair, replace, move or raise the wall, and whether a dock, lift, drain or vegetation will change.
Ask: “Which application and plan checklist fits this scope? What other reviews should be resolved before work starts? Who can confirm the required inspections?” Save the response with the date and the staff member’s name.
A canal and a natural lagoon edge are different
Brevard’s residential marine page describes manmade waterways. County environmental review also addresses the Indian River Lagoon system, including canals, and its current code distinguishes residential-canal bulkheads from natural-water shorelines.
For a natural lagoon edge, ask about shoreline alternatives, existing-wall condition and habitat requirements before choosing vertical replacement. For oceanfront property, separately ask DEP whether Chapter 161 and the Coastal Construction Control Line apply.

What does an exemption actually settle?
Qualifying restoration under Florida section 403.813(1)(e) has location and scope conditions, including restoration at the previous location, upland, or within 18 inches waterward. It expressly preserves Chapter 161 coastal requirements. This is not a universal permission to extend a wall.
The 2026 statute says a local government may not demand further DEP verification from a person claiming its listed exceptions. Other local requirements and submerged-land permissions remain relevant. Ask for an applicability discussion when the facts are uncertain; do not assume a DEP exemption letter is always mandatory.
Build one consistent application package
- Identify the owner, parcel, jurisdiction and existing authorized shoreline.
- Show wall alignment, returns, cap, drainage, docks, lifts and utilities on coordinated drawings.
- Map native vegetation, construction access, staging and turbidity protection.
- Keep the survey date, vertical datum and property-line information visible.
- Describe demolition, temporary work and final restoration—not just the finished wall.
The county marine checklist asks for sealed construction documents, a recent survey and a dimensioned plot plan. Municipal requirements can differ; use the city’s current checklist for its own parcels.

Who is responsible for each approval?
Make one short tracker before mobilization. The row for each applicable review should have a responsible person, an application number, the latest decision and the drawing revision it covers.
| Decision | Record to request |
|---|---|
Local building review | Issued permit, approved plan set, conditions and required inspections. |
Environmental or submerged-land review | Applicable authorization or the documented basis for an exemption. |
Property or association permission | Written approval or access agreement where the project needs it. |
Changes during work | Revised plans and the authority’s response before relying on the change. |
Closeout | Final inspection result and any required completion or as-built records. |
Use “not applicable—confirmed by…” when a review does not apply. An empty box is an unanswered question.
Coordinate state and federal questions separately
DEP Central District and SJRWMD provide environmental-resource guidance and permit records. Ask which agency reviews the actual activity and whether submerged-land authorization is needed. Federal applicability belongs with USACE.
Brevard’s Manatee Protection Plan and mapped speed zones matter when planning docks, expanded boat facilities or marine access. A wall-only repair and a larger marina proposal are different scopes.

What should you keep when the work is finished?
Retain approved revisions, final inspection results, any required as-built survey and the professional’s completion documents. Cocoa Beach specifies inspections when issuing the permit and requires final signoff. The county’s surface-water application also addresses as-built and final-inspection records.
An application receipt is not a construction authorization, and an issued permit is not proof of final approval. Use the property-record checklist when buying or closing out a project.

Questions that often come next
Can one application cover the wall and dock?
Describe the complete work to the local office and each relevant reviewing agency. Ask how the scopes should be submitted and linked. One application number should not be treated as proof that all structural, environmental and property-permission questions are resolved.
What if the contractor says the work is exempt?
Ask which activity qualifies, which authority the exemption concerns and what conditions must stay true. Keep that explanation with the scope and obtain confirmation from the reviewing office where needed. A change in alignment, fill, vegetation or use can require a fresh discussion.
